On May 14, 2021, the Consumer Financial Protection Bureau (CFPB) updated its TRID FAQs to include questions and answers regarding housing assistance loans under the Truth-in-Lending/Real Estate Settlement Procedures Act Integrated Disclosure Rule, as implemented by Regulation Z (12 CFR 1026).

The Q&As discuss that housing assistance loans are generally subject to TRID but may meet a partial exemption. There are two partial exemptions possible: (1) the regulatory partial exemption in Regulation Z, 12 CFR §1026.3(h); or 2) the statutory partial exemption in the TILA and RESPA statutes, provided through amendments made by the Building Up Independent Lives and Dreams Act (BUILD Act) (BUILD Act Partial Exemption). The added Q&As review the criteria for the partial exemptions and any applicable or appropriate disclosures.
